In consideration of the N.C. Supreme Court’s May 2009 ruling in North Carolina Dept. Correction v. North Carolina Medical Board, the Medical Board voted to approve changes to its Position Statement on Capital Punishment. In that opinion, the court stated the Board “may not discipline or threaten discipline against its licensees solely for participating in the execution alone.” The Board continues to take the position that physician participation in capital punishment is a departure from the ethics of the medical profession, citing the provisions of AMA Code of Medical Ethics Opinion 2.06.
