Periodic Rule Review

The Regulatory Reform Act of 2013 requires all state agencies, including occupational licensing boards, to review the North Carolina Administrative Code (aka “rules”) every ten years.  The rationale was the concern that some agencies have rules which are decades old, and are probably no longer relevant or necessary.  In accordance with this bill, the Board has made an initial designation for each of its rules as one of the following:

(1) Necessary with substantive public interest: Means any rule for which the agency has received public comments within the past two years or if the rule affects the property interest of the regulated public and the agency knows or suspects that any person may object to the rule.

(2) Necessary without substantive public interest: Means a rule for which the agency has not received a public comment concerning the rule within the past two years or that merely identifies information that is readily available to the public, such as an address or a telephone number.

(3) Unnecessary: Means a rule that the agency determines to be obsolete, redundant or otherwise not needed.

Public comment means written comments objecting to the rule, in whole or in part, received by an agency from any member of the public, including an association or other organization representing the regulated community or other members of the public.

Comments must address the content of the rule to be considered by the Rules Review Commission.
